Terms of Service

These Terms of Service ("Terms") govern your access to and use of daymesh.com and the daymesh service (collectively, the "Service"), operated by daymesh ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use daymesh. By using the Service, you represent that you meet this requirement and that the information you provide is accurate and complete. If you are using daymesh on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Your Account

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately at [email protected] if you suspect unauthorised access to your account.

Usernames must not impersonate another person or entity, contain offensive language, or violate any third-party trademark. We reserve the right to reclaim usernames that violate these guidelines.

3. Acceptable Use

You may use daymesh to aggregate iCal feeds that you are authorised to access. You agree not to:

  • Add iCal feed URLs for calendars you do not own or do not have permission to access or redistribute.
  • Aggregate or redistribute private, confidential, or access-controlled calendar feeds without the explicit consent of the calendar owner.
  • Use daymesh to scrape, harvest, or systematically collect data from third-party services in violation of their terms of service.
  • Attempt to gain unauthorised access to any part of the Service, its servers, or other users' accounts.
  • Use the Service to transmit spam, malware, or any content that is illegal, harmful, or harassing.
  • Circumvent, disable, or interfere with security-related features of the Service, including rate limiting.
  • Resell, sublicense, or provide access to the Service to third parties without our written permission.
  • Use automated means (bots, scrapers) to access the Service beyond normal programmatic use of the documented API and feed URLs.

We may investigate suspected violations and, at our sole discretion, suspend or terminate accounts that violate these rules.

4. Content and Intellectual Property

You retain all rights to the calendar data you provide to daymesh. By adding source feed URLs, you grant us a limited, non-exclusive licence to fetch and process the calendar data at those URLs solely to provide the Service to you.

The daymesh name, logo, and website design are our intellectual property. You may not use them without our prior written consent. All rights not expressly granted here are reserved by us.

5. Service Availability

We aim to provide a reliable service but we do not guarantee any specific level of uptime or availability:

  • Free plan: No uptime guarantee. Maintenance windows and outages may occur without advance notice.
  • Pro and Business plans: We endeavour to maintain high availability and will communicate planned maintenance in advance where possible, but we make no formal SLA commitment at this time.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will give reasonable notice before discontinuing a paid feature or the Service entirely.

6. Paid Plans and Billing

Some features are available only on paid plans (Pro at $5/month, Business at $15/month). Paid plan pricing, features, and billing terms are described on the pricing page and are subject to change with reasonable notice.

Refunds are evaluated on a case-by-case basis. Contact [email protected] within 14 days of a charge if you believe you were billed in error.

If a paid subscription lapses or is cancelled, your account reverts to the Free plan. Data created under a higher plan tier is retained but may become inaccessible if it exceeds Free plan limits.

7. Account Termination

You may delete your account at any time from account settings. Deletion is permanent and removes all your calendars, feeds, analytics data, and personal information.

We may suspend or terminate your account immediately, without notice, if we determine in our sole discretion that you have violated these Terms, engaged in abusive behaviour, or pose a risk to the security or integrity of the Service or other users. We will endeavour to provide notice and an opportunity to cure violations where it is reasonable to do so.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any particular third-party iCal feed will be successfully fetched or accurately merged.

9. Limitation of Liability

To the maximum extent permitted by applicable law, daymesh and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or loss of business opportunity, arising out of or related to your use of or inability to use the Service.

Our total cumulative liability to you for any claim arising out of or related to these Terms or the Service shall not exceed the greater of (a) the total amount you paid us in the twelve months preceding the claim, or (b) $10 USD.

10. Indemnification

You agree to indemnify and hold harmless daymesh and its operators from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any third-party rights, including intellectual property or privacy rights.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Michigan, United States, without regard to its conflict of law provisions.

Any dispute arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in Michigan, and you consent to personal jurisdiction in those courts. Before initiating formal legal proceedings, you agree to attempt to resolve the dispute informally by contacting us at [email protected].

12. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you by email. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
